3-Year Term For Osburne

Truman E Osburne, 23, was sentenced to 3 years in the state penitentiary at Fort Madison Monday after pleading guilty before District Judge Tom K Murrow to a charge of conspiracy.
Osburne, who has been jailed here on assault charges at least 10 times in the last four years, was accused of conspiring with two boys, 15 and 17 years old, to break into the Pantry Cafe, 917 Sixth ave. Oct. 21.
Were Indicted
Osburne and the two youths were indicted for breaking and entering by the Polk county grand jury.
The 15-and-17-year-old both pleaded guilty before Judge Murrow, and under a little used Iowa law, were transferred to juvenile court for sentencing.
While awaiting sentencing by juvenile court, the younger boy has been released to his parents and the17-year-old is being held in the county juvenile home. District Judge Joseph E Meyer set Dec 14 as the date for passing sentence on the two boys.
Since Osburne had pleaded guilty to the lesser charge of conspiracy, the indictment charging him with breaking and entering will be dismissed, Assistant County Attorney Cloid Level said.
The two boys told authorities they broke into the cafe at Osburne's suggestion, but said he did not go with them. They said he agreed to help them get a car which they could drive to Denver, Colo., if they would give him the money.
Tried To Steal Car
An undetermined amount of coins was taken from a juke box and pinball machine at the cafe.
Police arrested the two boys later that same night after they tried to steal a car near Hotel Fort Des Moines.
They told police Osburne had refused after the burglarly to help them get a car but had showed them how to turn on a car's ignition with a bobby pin.
Two 14-year-old girls who were keeping company with the two younger boys at a local hotel were not held.
Osburne gave his address as 3410 Bowdoin st.
