Free Slayer of Osburne: Self-Defense

A Des Moines bartender was freed Sunday after he told police he shot Truman Osburne in self defense.
Osburne, 25, a former convict with a long record of trouble-making, was slain Saturday night at The Keg Tavern, 936 Sixth ave.
"A Wild Man"
Jessie Rodriquez, 35, said he shot Osburne as "he came over the bar at me like a wild man."
Detective Lt Paul Nessen said investigation has revealed no reason to hold Rodriquez. Pold County Coroner Leo Luka said that no inquest is planned.
Osburne and a girl friend came into the tavern and Osburne ordered a beer. Rodriquez said to refused to serve Osburne.
The bartender told police that Truman and his brother Wilbur, 38, also a former convict, had been involved in a fight at the tavern Thursday night.
When Truman went back to the tavern Friday night, he was told he no longer would be served, Rodriquez saidd.
Told To Leave
When he arrived at the tavern Saturday night, Rodriquez said, Truman was told that he had better leave and that he "Should think twice before causing any trouble."
An argument ensued and, Rodriquez said, Truman started over the bar toward him.
Rodriquez shot him once with a 7.6-mm automatic that was kept behind the bar. The bullet pierced Osburne's jugular vein and he died three minutes after arrival at Broadlawns General Hospital.
Police questioned Osburne's companion, Judy Long, 23. She told police that Osburne had said nothing about "getting even " with Rodriquez.
She said it appeared to her that Osburne was leaning, not climbing, over the bar when he was shot.
Husband In Jail
Police said her husband, Jerry, is serving a term in Missouri for breaking and entering.
Police have a long record of arrests for Truman. His four brothers-Lyle, 23, Robert Adriene, 27; Russell, 33, and Wilbur-have all been arrested at various times. Lyle presently is in the Fort Madison penitentiary.
